By activating, accessing, or using a membership at ONYX Fitness Ramsbottom Ltd (“the Gym”), all members agree to be legally bound by the following Terms & Conditions.

These Terms are designed to protect the safety, security, wellbeing and legal interests of all members and the Gym as a 24-hour partially or on occasion an unmanned fitness facility.

ONYX Fitness Ramsbottom Ltd operates as a 24-hour gym facility. Members acknowledge and accept that there may be periods where the Gym is fully or partially unmanned and no staff are present on site.

During unstaffed or unmanned hours:

• No supervision, instruction, coaching, safeguarding, or assistance is provided;
• Members exercise independently and entirely at their own risk;
• Members are solely responsible for their own health, safety, conduct and use of equipment;
• Minor Members aged 16–17 remain the responsibility of their parent or legal guardian at all times.

Members acknowledge and accept that:

• ONYX Fitness Ramsbottom Ltd is not responsible for supervising members during unmanned hours;
• the Gym does not provide monitoring of exercise activities or member conduct during unmanned periods;
• use of the facility during unmanned hours is voluntary and entirely at the member’s own risk except where liability cannot legally be excluded by law.

CCTV operates throughout the premises for safety, security, safeguarding and monitoring purposes.

The Gym reserves the right to refuse entry, suspend access or terminate memberships where safety, security, safeguarding, or behavioural concerns arise.

By using the Gym, members confirm that:

• they are physically and medically fit to exercise;
• they have no medical condition, illness, injury or impairment that may affect their ability to exercise safely unless medical advice or clearance has been obtained;
• they accept full responsibility for monitoring their own physical condition during exercise.

ONYX Fitness Ramsbottom Ltd does not provide medical advice, health screening or fitness assessments unless expressly stated in writing.

In the event of an emergency, members must:

• call 999 immediately;
• follow all emergency instructions displayed within the Gym.

Emergency equipment including first aid kits and fire extinguishers are provided for emergency use only.

ONYX Fitness Ramsbottom Ltd accepts no responsibility for injury, loss or damage arising from misuse of emergency equipment by members or visitors.

ONYX Fitness Ramsbottom Ltd maintains Public Liability Insurance.

This insurance only provides cover where injury, loss, or damage results directly from proven negligence by the Gym.

The Gym shall not be liable for injury, illness, death, loss, theft, damage, or accident arising from:

• misuse of equipment;
• failure to follow Gym rules or safety guidance;
• exercising beyond personal capability;
• unsupervised exercise;
• actions or omissions of other members;
• unauthorised access;
• or breaches of these Terms & Conditions.

Nothing within these Terms excludes liability for death or personal injury caused by negligence where such liability cannot legally be excluded under applicable law.

Access to the Gym is granted strictly via authorised access methods only, including but not limited to:

• fingerprint access;
• access codes;
• approved digital credentials.

Access credentials are:

• personal;
• non-transferable;
• the sole responsibility of the registered member.

The following are strictly prohibited:

• sharing access credentials;
• permitting entry to non-members;
• “tailgating” or allowing unauthorised persons to enter the Gym.

Any breach may result in:

• immediate suspension;
• termination of membership without refund;
• refusal of future access;
• or legal action where appropriate.

Members must report:

• lost credentials;
• suspicious activity;
• security concerns;
• or unauthorised access immediately.

No person under the age of 16 may obtain, activate, access or use the Gym under any circumstances.

Members aged 16 or 17 (“Minor Members”) may only obtain or use a membership with the express written consent of a parent or legal guardian.

ONYX Fitness Ramsbottom Ltd reserves the absolute right to:

• request proof of age;
• request proof of parental responsibility;
• refuse or revoke access for any Minor Member at any time.

The parent or legal guardian of any Minor Member accepts full legal and personal responsibility for:

• the Minor Member’s conduct, behaviour and actions within the Gym;
• ensuring the Minor Member is physically and medically capable of exercising safely;
• ensuring the Minor Member complies fully with all Gym rules, safety guidance and instructions;
• monitoring and supervising the Minor Member where appropriate.

Parents/guardians acknowledge and accept that:

• ONYX Fitness Ramsbottom Ltd is not a childcare provider;
• the Gym does not provide supervision, safeguarding, monitoring, coaching or care services during unmanned hours;
• use of the Gym by any Minor Member is entirely at the parent/guardian’s and member’s own risk except where prohibited by law.

Members acknowledge that the Gym operates on a partially or on occasion an unmanned basis.

During unstaffed or unmanned hours:

• no supervision of Minor Members is provided;
• no staff are present to monitor conduct or safety;
• no responsibility is accepted for supervising or monitoring Minor Members.

Parents/guardians remain fully responsible for Minor Members at all times whilst using the facility.

Providing false age information, false parental consent or permitting unauthorised access constitutes a serious breach of these Terms & Conditions.

Where a parent or guardian knowingly permits:

• unauthorised access;
• unsupervised misuse of the facility;
• sharing of access credentials;
• or breaches of Gym rules,

the parent/guardian accepts full responsibility and liability for any resulting injury, damage, loss, conduct, or incident.

Members must:

• use all equipment correctly, safely and responsibly;
• only perform exercises they are competent to undertake safely;
• seek guidance during staffed hours if unsure regarding equipment use.

Faulty or damaged equipment must:

• be reported immediately;
• not be used under any circumstances.

All equipment must be wiped down after use and returned to its designated area.

ONYX Fitness Ramsbottom Ltd accepts no liability for injuries arising from:

• incorrect use of equipment;
• reckless behaviour;
• failure to follow safety guidance;
• or exercising beyond personal capability.

Members must behave respectfully toward:

• other members;
• staff;
• the facility;
• and equipment.

The following may result in immediate suspension or termination of membership without refund:

• harassment;
• threatening or aggressive behaviour;
• unsafe conduct;
• damage or misuse of equipment;
• illegal activity;
• breach of these Terms & Conditions.

ONYX Fitness Ramsbottom Ltd reserves the absolute right to refuse entry, suspend access or terminate memberships where behaviour is considered unsafe, inappropriate, disruptive or unlawful.

ONYX Fitness Ramsbottom Ltd may use third-party providers, including Ashbourne Management Services, for membership administration, customer service, payment processing and account management.

Members remain fully responsible for complying with these Terms & Conditions regardless of any third-party administration arrangements.

Personal data is processed in accordance with UK GDPR and applicable Data Protection legislation.

Personal information will not be shared with third parties without consent unless required by law.

ONYX Fitness Ramsbottom Ltd reserves the right to amend these Terms & Conditions at any time.

Members will be notified of significant changes where appropriate.

Continued use of the Gym following any amendments constitutes acceptance of the revised Terms & Conditions.

These Terms & Conditions form part of the legally binding membership agreement.

By activating, accessing, or using the facilities, members confirm that they have:
