By activating or using a membership at ONYX Fitness Ramsbottom Ltd (“the Gym”), you agree to be legally bound by the following Terms & Conditions.

These Terms are designed to ensure the safety, security, and wellbeing of all members while protecting the Gym as a 24-hour unmanned facility.

ONYX Fitness Ramsbottom Ltd operates as a 24-hour, unmanned gym facility. Members acknowledge and accept that there will be periods when no staff are present on site.

During unstaffed hours:

• No supervision, instruction, coaching, or assistance is provided
   
• Members exercise independently and at their own discretion
   

All members enter and use the premises and equipment entirely at their own risk.

CCTV operates throughout the premises for safety, security, and monitoring purposes.

Members confirm that:

• They are physically and medically fit to undertake exercise
   
• They have no medical condition, injury, illness, or impairment that may affect their ability to exercise safely unless medical clearance has been obtained
   
• They accept full responsibility for monitoring their own physical condition while exercising
   

ONYX Fitness Ramsbottom Ltd does not provide medical advice or fitness assessments unless expressly stated in writing.

In the event of an emergency, members must:

1. Call 999 immediately
    
2. Follow all posted emergency instructions
    

First aid kits and fire extinguishers are provided for emergency use only.
ONYX Fitness Ramsbottom Ltd accepts no responsibility for injury or damage resulting from the misuse of emergency equipment by members.

ONYX Fitness Ramsbottom Ltd holds Public Liability Insurance, which provides cover only where injury, loss, or damage arises as a direct result of proven negligence on the part of the Gym.

This insurance does not cover incidents arising from:

• Misuse of equipment
   
• Failure to follow these Terms & Conditions
   
• Failure to exercise safely, responsibly, or within personal capability
   
• Acts or omissions of other members
   

Access to the Gym is granted strictly via authorised access methods only (e.g. fingerprint, code, approved credentials).

Access credentials are:

• Personal
   
• Non-transferable
   
• The sole responsibility of the member
   

Allowing any non-member or unauthorised individual to enter the Gym (“tailgating”) is strictly prohibited and may result in immediate termination of membership without refund.

Members must report lost credentials, security concerns, or suspicious activity immediately.

Members must:

• Use all equipment correctly, safely, and responsibly
   
• Only attempt exercises they are competent to perform safely
   
• Seek guidance during staffed hours if unsure about equipment use
   

Faulty or damaged equipment must:

• Be reported immediately
   
• Not be used under any circumstances
   

All equipment must be wiped down after use and returned to its designated area.

ONYX Fitness Ramsbottom Ltd accepts no liability for injuries resulting from incorrect use of equipment or failure to follow safety guidance.

Family memberships are subject to the following conditions:

• Children must be accompanied and directly supervised at all times by a parent or legal guardian
   
• Family and child access is restricted to staffed hours only, unless expressly authorised in writing by ONYX Fitness Ramsbottom Ltd
   
• Children may not use equipment unsuitable for their age, size, or physical development
   
• Certain areas may be restricted to adult use only
   

The parent or legal guardian:

• Accepts full responsibility for the child’s safety, conduct, and actions
   
• Accepts all risks on behalf of the child
   

Both parent/guardian and child use the facility entirely at their own risk, except where injury results from proven negligence by the Gym.

Members must behave respectfully toward:

• Other members
   
• Staff
   
• The facility and equipment
   

The following may result in immediate suspension or termination of membership without refund:

• Harassment, intimidation, or aggressive behaviour
   
• Unsafe conduct
   
• Misuse or damage of equipment
   
• Breach of these Terms & Conditions
   
• Illegal or unlawful activity
   

ONYX Fitness Ramsbottom Ltd reserves the absolute right to refuse access or terminate membership where behaviour is deemed unsafe, disruptive, or inappropriate.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence where such liability cannot be excluded by law.

Subject to this:

• Members use the Gym entirely at their own risk
   
• ONYX Fitness Ramsbottom Ltd shall not be liable for any injury, illness, loss, theft, damage, or accident except where caused by proven negligence of the Gym
   

Members agree to fully indemnify and hold harmless ONYX Fitness Ramsbottom Ltd, its directors, employees, and agents against any claims, losses, or damages arising from:

• Breach of these Terms & Conditions
   
• Misuse of equipment
   
• Failure to exercise responsibly
   
• Actions or omissions of the member or their guests
   

Personal data is processed in accordance with UK GDPR and Data Protection legislation.

Personal information will not be shared with third parties without consent unless required by law.

Members will be notified of significant changes. Continued use of the facility constitutes acceptance of the revised Terms.
